Food Help for Asylum Seekers
~1M+ pending asylum cases at EOIR (FY24 backlog). Asylum seekers face unique barriers — pre-decision they do NOT qualify for SNAP, TANF, or Medicaid. This page lists resources during the waiting period, and the full benefits available after asylum is granted.
IMPORTANT: Don\u0027t confuse asylum seekers (pre-decision) with asylees (post-decision) or refugees (pre-arrival status). Benefits change dramatically by status.
1. Pre-decision — no federal SNAP
While awaiting asylum decision, you do NOT qualify for federal benefit programs:
- ❌ SNAP / EBT
- ❌ TANF
- ❌ Medicaid (excepción: emergencia, embarazada en algunos estados)
- ❌ Federal housing
- ❌ Lifeline phone
BUT you DO have access to private + state + local resources:
- ✓ Community pantries (no status verification)
- ✓ Religious pantries (no verification)
- ✓ WIC (you ARE eligible — only federal program without status verification)
- ✓ Some state programs (NY, CA, IL offer alternatives)
2. Asylum NGOs with food assistance
- USCRI (US Committee for Refugees and Immigrants) — refugees.org. Resettlement programs include temporary food assistance.
- IRC (International Rescue Committee) — rescue.org. Comprehensive support including food + housing + training.
- Catholic Charities — catholiccharitiesusa.org. Network of >1,500 offices. Pantries + hot meals + family support.
- RAICES — raicestexas.org. Texas-specific but with national network. Legal aid + resources.
- LIRS (Lutheran Immigration Refugee Service) — lirs.org. Links to local Lutheran churches with pantries.
- Hebrew Immigrant Aid Society (HIAS) — hias.org. Comprehensive service.
- National Network for Immigrant and Refugee Rights — nnirr.org
3. EAD — work permit (150-day wait)
Under INA § 208(d)(2), asylum seekers can apply for Employment Authorization Document (EAD) 150 days after filing I-589. Once approved, can work legally.
- File I-589 (Asylum Application) immediately upon arrival
- Wait 150 days
- File I-765 (EAD) on day 150
- USCIS approves typically 30-60 days later
- Typical total: 6 months from arrival to legal work
- No legal work during this window — rely on networks / pantries
4. Post-asylum granted — full benefits
Once asylum is granted (positive decision from immigration judge or DHS), you have full benefits as an asylee:
- SNAP — IMMEDIATE eligibility (no 5-year wait like LPR)
- TANF — immediate eligibility
- Medicaid — immediate eligibility
- Refugee Cash Assistance (RCA) — cash assistance for 8 months (can be combined with TANF)
- Refugee Medical Assistance (RMA) — medical coverage for 8 months
- Match Grant Program — federal resettlement grant — housing + food + training
- SSI — can apply immediately if disabled or 65+
- Wage Subsidy Program — some states pay part of salary while asylee trains for new job
5. Children asylum seekers
- School meals — all kids in US public schools eligible for free/reduced lunch regardless of immigration status (Plyler v. Doe, 1982)
- WIC — pregnant women + kids under 5 eligible without status verification
- Migrant Head Start — meals + care for 6-week-5-year-olds
- Colleges — some (CA, NY, IL) offer in-state tuition to pending-asylum students
